Qualified Referral Details of Participation
This promotion is sponsored by Bluegreen Vacations Unlimited, Inc. d/b/a Bluegreen Vacations ("Bluegreen Vacations" or “BVU”), a Florida corporation whose address is 4960 Conference Way North, Suite 100, Boca Raton, FL 33431, in order to introduce you to timeshare ownership. Bluegreen Vacations is the developer/seller of the Bluegreen Vacation Club ("BVC"), Bluegreen Vacations is the developer and seller of the Bluegreen Vacation Club, a multi-site timeshare plan. Everyone over the age of majority is welcome to visit our preview center or resort sales office and purchase; however, in order to participate in this promotional offer, you and your spouse or cohabitating significant other (if applicable) must meet the requirements set forth herein at the time of your purchase of, and travel on, this vacation package. If you and your spouse or cohabitating significant other (if applicable) do not meet these requirements, you will not be eligible to receive any gifts and/or accommodations in connection with this offer. If you do not meet these requirements, but you or your spouse or cohabitating significant other have received gifts and/or accommodations, you will be charged the verifiable retail value for such gifts and/or accommodations, plus all applicable taxes, less any payments made by you. If you are married or cohabitating with a significant other, you and your spouse or significant other (as applicable) are hereinafter collectively referred to herein as “We” or “Us:”
I am, or at least one of Us is, 25 years of age or older. I or We each (if married or cohabitating with a significant other) have a valid driver's license or government-issued identification. I have, or at least one of Us has, a valid personal credit card bearing a MasterCard,® Visa,® American Express,® or Discover® logo. I or We (if married or cohabitating with a significant other) have a gross annual household income of at least $50,000 (this income requirement may be waived if one of Us is 62 years of age or older) and I understand that I, or at least one of Us, must be creditworthy as detailed below. If cohabiting with a significant other and combining income, I understand that proof of cohabitation through government-issued identifications showing identical home addresses is required. I agree that I (or We if married or cohabitating with a significant other) must attend and complete an approximately two-hour Bluegreen Vacation Club® sales presentation and tour on the benefits of timeshare ownership at the Bluegreen Vacations preview center in my selected destination area. If married, or cohabiting, both individuals must attend and complete the timeshare sales presentation and tour together. I or We each (if married or cohabitating with a significant other) understand that neither of Us may participate in any promotional or other offer made by another vacation ownership company or travel club while traveling on this Package. (Group travel on this vacation package is not permitted. Group travel is defined as traveling with friends or family on separately purchased vacation packages to the same destination during overlapping travel dates. Taxes on accommodations will apply and are my sole responsibility upon check-out. If applicable, I understand that if I reschedule a vacation package reservation booked within 30 days of the vacation package purchase date, I will no longer be eligible to receive this reservation incentive.
I understand that I, or at least one of Us (if married or cohabitating with a significant other), must: (i) have a minimum credit score as established by this offer's sponsor (currently a FICO® score of 600); or (ii) if FICO® information is not readily available, meet Bluegreen’s internal financial risk underwriting requirements. I also understand that if I, or if I and my cohabitating significant other or spouse, have filed for bankruptcy protection or been adjudicated bankrupt or insolvent within the past 7 years, I/We are not eligible for this offer. I understand that my and/or my spouse’s or cohabitating significant other’s (if applicable) precise credit score(s) will only be verified through a hard inquiry upon my or our (if applicable) consent and decision to purchase a timeshare interest or Sampler product from Bluegreen Vacations. Bluegreen Vacations reserves the right to change these qualifications without notice. Attendance at an approximately two-hour BVC timeshare sales presentation and tour is required to be eligible for this promotion. The timeshare sales presentation will be in English. By accepting this offer and to meet its eligibility requirements, you affirm that you (or We if married or cohabitating with a significant other) are conversant in the English language and have read and understand these Details of Participation. A promotional gift may be offered with this promotion to be provided upon completion of the timeshare sales presentation and tour (or earlier if required by law). Travel must be completed within 12 months of the issue date of the vacation package. Verified retail value of accommodations is a rate between $171.00 and $979.00 per night, based upon travel season, check-in dates, destination and vacation package offer, unless stated otherwise. Additional charges may apply during weekends, peak periods and holiday stays. Verified retail value of promotional items offered is up to $200.00, unless stated otherwise. Bluegreen Vacations reserves the right to substitute promotional item(s) at equal or greater value. Transportation, additional expenses, and applicable room and other taxes are the sole responsibility of the recipients. Pets and boats are not permitted, and motorcycle and RV restrictions may apply in certain destination areas. You may request and will receive documentation showing that the vacation package provided matches the vacation package selected by you. This offer is made on a space-available basis and is non-transferable. One offer per family. No purchaser should rely on representations other than those included in these Details of Participation. Bluegreen Vacations acts as an agent for hotels, attractions, and other services supplied as part of the vacation package and will not assume any responsibility and shall not be liable for any loss, cancellation costs, accidents, injuries, damage to persons or property, indirect, incidental, special consequential, or punitive damages arising from, or in conjunction with, any of these services. All operators, including air carriers, hotels, car rental companies and attractions mentioned are independent contractor suppliers, each of which has obligations toward and limitations in respect to liability to the purchaser directly. Bluegreen Vacations is not responsible for cancellations or interruptions due to nature, strikes, terrorism, or Acts of God. If you are a resident of a country other than the U.S., Canada or the U.K., you may be ineligible for this promotion and it may be withheld in the sponsor's sole discretion. You agree that you and all the members of your traveling party will meet Bluegreen’s health screening requirements which may include, among other things, answering a brief series of health-status questions and a non-invasive temperature check.
Late Cancellation/No-Show Policy: Because Bluegreen Vacations subsidizes the cost of this vacation package in order to offer it to you at a discounted price, Bluegreen Vacations has instituted this Late Cancellation/No-Show Policy. Your scheduled check-in day may be modified at no charge only if the request is made AT LEAST FOURTEEN (14) DAYS PRIOR TO THE SCHEDULED CHECK-IN DATE. If your check-in date is modified less than fourteen (14) days prior to this check-in date, a $125.00 Late Cancellation Fee will be required. Participants with reservations who fail to show up on their scheduled check-in date, will have a $200.00 No-Show Fee charged to their debit card or credit card (dependent upon the method of payment used to purchase the vacation package), and will forfeit any prepaid fees or deposits. By making a reservation in response to this promotion, you are agreeing to this policy.
Cancellation Policy: Notwithstanding the foregoing or otherwise, you may cancel and request a refund at any time within thirty (30) days following the date that you purchased your vacation package, and the refund amount will be the purchase price of the vacation package less the retail value of any gift(s) and/or accommodations received. The cancellation must be in writing and mailed to Bluegreen Vacations, Attn: Bluegreen Vacations, 8325 South Park Circle, Suite 200 Orlando, FL 32819. Any cancellation made more than thirty (30) days after the purchase date will result in forfeiture of your vacation package purchase price. Residents of AR, AZ, LA, MI, NM, OH, VA and WI should refer to the additional inserts regarding your cancellation rights enclosed with your fulfillment materials. **A Qualified Referral must: (A) be conversant in English; (B) be registered with Bluegreen Vacations as a current Qualified Referral of the referring Owner; (C) be “personally known”*** to the referring Owner; (D) qualify to purchase a deeded vacation club interest from Bluegreen Vacations pursuant to its then current underwriting requirements; (E) not be a resident of ND, or SD or of certain countries outside of the United States (as determined by Bluegreen Vacations from time to time).
***To be "personally known" to a Bluegreen Owner: 1.) a Qualified Referral must have knowledge that the participant submitted his/her name to Bluegreen Vacations prior to submission; and 2.) the participant must not require compensation from the Qualified Referral for submitting the Qualified Referral's name to Bluegreen Vacations. In all instances, Bluegreen Vacations shall have the exclusive right to determine if a referral is "personally known" to the referring Owner and/or if a referral constitutes a Qualified Referral.
